General terms and conditions of the e-store at www.kambukka.com
This e-store is operated by Bibo Brands BV, with registered office at Torenplein 7.16.1, 3500 Hasselt (BE), and with VAT number BE 0819.303.966 // NL 824345526B01 (hereinafter also referred to as “Bibo Brands” or “The Seller”).
All orders and sales via this e-store are exclusively governed by the following sales and delivery terms and conditions (hereinafter also referred to as “The General Terms and Conditions”).
Bibo Brands is entitled to amend or change its General Terms and Conditions at any time. The amended General Terms and Conditions only apply to orders placed after the date of the amendment. It is the customer's responsibility to refer to these General Terms and Conditions with each new order.
1. Order
Before an order can be completed, you must expressly accept our General Terms and Conditions. Without acceptance of our General Terms and Conditions, your order cannot be placed.
The customer will receive a confirmation of his/her order by e-mail after the purchase is completed. The sales agreement is only concluded at the moment Bibo Brands sends a confirmation e-mail to the e-mail address provided by the customer. Bibo Brands reserves the right to refuse orders under different conditions or if stocks are exhausted.
Orders confirmed by Bibo Brands can in principle no longer be changed, except in the following cases:
Orders are processed every working day from 08:30 to 22:30. Orders placed after 22:30 will be processed the following working day. Orders that are personalized take up to 7 business days to process.
2. Shipping and delivery
Products are only delivered in the countries for which the website allows delivery, as indicated during the ordering process. This excludes islands.
The customer is responsible if the customer specifies the delivery address incorrectly, and may have to pay extra charges.
Unless otherwise agreed, the prices stated in our e-store do not include the shipping and delivery of the products to the customer. The costs of shipping and delivery are specified separately before the order is completed.
The specified delivery times are merely indicative, and not binding on Bibo Brands. Any delay in delivery can never give rise to termination of the purchase or payment of compensation to the customer, except in the case of deliberate delay attributable to Bibo Brands. We are entitled to make partial deliveries. If the products are not delivered, any sums paid by the customer will be refunded, without interest or other compensation.
Products are only shipped after payment in full of the amount due.
Deliveries are shipped for free in the following circumstances:
To Belgium, for purchases of €35 or more
To the Netherlands/Germany, for purchases of €35 or more
To France/The UK, for purchases of €45 or more
To Denmark/Austria/Poland/Luxembourg, for purchases of €60 or more
To Italy/Spain/Finland/Hungary/Ireland/Croatia/Portugal, for purchases of €70 or more
To all other countries to which Bibo Brands delivers to, for purchases of €80 or more
Packages take about 1 to 4 working days to arrive, depending on the country:
Belgium/Luxembourg/Netherlands: 1 working day
France: 2 working days
Germany: 2 working days
UK: 3 working days
Ireland: 3 working days
Italy: 4 working days
Spain: 3 working days
Other European countries: 3 to 5 working days
As soon as your package leaves our premises, you will receive an e-mail from the e-store system with a shipping confirmation. In principle, you will also receive an e-mail from the carrier informing you that the products have been collected and are being prepared for delivery. You can reply to this e-mail to postpone the delivery of the products, or specify a different delivery address.
The carrier will attempt to deliver the package to the delivery address specified by you on up to 2 occasions, at the time specified in an e-mail sent to you. If you are not present on either of these occasions, and in the meantime the carrier is not informed of a change of delivery address or other delivery option via the options made available by the carrier, the products will be returned to Bibo Brands. If this happens, you will have to place your order again and you will have to pay the shipping costs again.
The shipping costs differ from country to country:
At the moment we can only send parcels to those countries on the list of countries in the e-store (excluding islands), which can be consulted during ordering.
3. Prices and payment options
The prices stated in the e-store are in euros and inclusive of VAT. The prices on the e-store exclude shipping. Shipping is listed separately, and charged when completing the order. Purchases can only be paid online.
All prices are per item, unless stated otherwise.
Prices are subject to possible substantive errors. Bibo Brands is not liable for the consequences of these errors, nor can it be bound by prices that have wrongly stated due to an error. If some time after a product is purchased the same product is discounted, the customer cannot claim a reimbursement of the price difference. Payments are always made at the time of order. The package will only be sent if payment is made correctly.
Bibo Brands accepts the following payment methods, among others: Mastercard, Bancontact
Bibo Brands may limit or broaden the payment options in the future. Bibo Brands is not liable for any direct or indirect damage suffered by the customer caused by making payment orders online.
The customer is not entitled to set off any claim against Bibo Brands against the amounts charged by the company.
4. Right of withdrawal
The customer/consumer is entitled to inform Bibo Brands that he/she renounces the purchase and wishes to revoke it, without payment of any penalty and without the necessity for any reason, within 14 calendar days from the day following the delivery of the products.
In order to exercise this right of withdrawal, you must let us know of your decision to withdraw from the purchase within the aforementioned period with an unambiguous declaration. This declaration can be e-mailed to info@kambukka.com. If desired, you can use the withdrawal form to do this. We do our utmost to answer e-mails promptly.
Once we have confirmed receipt of your unambiguous declaration, return the product in its original packaging and at your own risk and expense to the following address: Newtonweg 10, 5928 PN Venlo, The Netherlands.
The product must be returned in unaltered and unused condition (including the labels). When returning, the original packing slip must always be attached to the package, together with a clear mention of your name and address. Shipping costs are borne by the customer, unless an error was made by Bibo Brands.
As soon as we have received the items in unaltered and unused condition, your money (including the initially paid standard shipping costs, with the exception of any additional costs as a result of you choosing a delivery method other than the cheapest standard shipping offered by us) will be refunded within 14 calendar days. We will refund you with the same payment method with which you made the original transaction, unless you have expressly agreed otherwise. In any event, you will not be charged for this reimbursement.
If the product is damaged by careless handling or by treating the product in a way that goes beyond what was necessary to determine the nature and characteristics of the product, or if an incomplete product is returned, the customer/consumer is liable for any loss in value of the product.
The customer cannot invoke any right of withdrawal for products personalised at the customer's request. The right of withdrawal is not available to professional customers.
5. Guarantee and defects
We want you to be satisfied with your purchase, so we offer you the following guarantees:
(i) A guarantee that our products meet the specifications stated in the e-store upon delivery;
(ii) The statutory guarantee in case of consumer purchase; and
(iii) A guarantee against hidden defects.
Bibo Brands guarantees that the products delivered to the customer are of excellent quality, and correspond to the specifications stated in the e-store at the time of delivery (*the colours of our product photos are always subject to change, and may differ from the actual product colours). Upon receipt of the package, the customer must immediately check the products for any non-conformity.
You also have a statutory guarantee of conformity on the purchased products in the EMEA. The guarantee is valid for 2 years from the date of purchase. Note that there is no lifetime warranty for Europe, Africa and the Middle East.
If the quality of the product received does not meet your expectations, or no longer meets them, you can submit a complaint to customerservice@kambukka.com. To be admissible, complaints must reach us: (i) in the event of a complaint about non-conformity of delivery, eight (8) days after delivery; (ii) in the case of the statutory consumer purchase guarantee, within two (2) months after you discover a lack of conformity; and (iii) in the case of hidden defects, eight (8) days after discovering the defect, or from the time when the defect could reasonably have been discovered.
We will gladly help you and solve the problem as soon as possible. This solution may involve repairing or replacing the product. If the replacement part you require is not available or no longer available, Bibo Brands reserves the right to send a replacement part, possibly of a different model or colour, but of equal value and compatible with your product. If repair or replacement is not possible, you can also be given an appropriate price reduction or the purchase can be cancelled.
Do remember: Attempting to repair a defect yourself or not following the user manual or instructions will render the guarantee null and void. Bibo Brands is also not liable for defects caused by use or intensive use. Poor maintenance can lead to defects, which will not be covered. The receipt must always be sent together with any defective products. The product returned must also be completely cleaned and in acceptable condition.
We are further only liable for damage that is the result of intent or gross error. We are never liable for general or special indirect damage, of whatever nature, suffered by the customer.
6. Privacy
We attach great importance to your privacy, so we process your personal data strictly in accordance with the applicable legislation and our privacy policy. For more information about this, refer to Bibo Brands’ privacy policy.
7. Jurisdiction clause – applicable law
Any dispute related to a purchase from our e-store falls under the jurisdiction of the courts and tribunals of Hasselt, Belgium, unless the customer is a consumer, in which case these disputes can also be handled by the court with territorial jurisdiction over the place of residence of the consumer, insofar as the consumer is resident in Belgium. Belgian law is exclusively applicable to these disputes.
8. Personalised products - Disclaimer
The Vendor also offers personalised products. These are drinking bottles upon which the customer can have an image or text printed.
Under no circumstances shall the Vendor be held liable for any information, images, text or works of intellectual or industrial property that have been supplied by the customer (whether this may be via the Vendor's website or otherwise). The Vendor shall not be bound to check the accuracy of the information supplied by the customer – in particular images, text and other works covered by intellectual, industrial or other property rights – or whether the information complies with current legislation, or whether third-party intellectual property rights exist. The full responsibility for all of this lies with the customer. The Vendor reserves the right to refuse any printing requests that would manifestly infringe the intellectual property rights of third parties and therefore reserves the right to dispatch the product without the product having been personalised.
The customer guarantees that the information provided – in particular images, text and other works subject to intellectual, industrial or other property rights – complies with the applicable laws and regulations. The customer undertakes to fully indemnify the Vendor and hold them harmless for any damage that the Vendor may suffer as a result of the provision of any information, images, text or works of intellectual or industrial property and for any claims made by third parties for any damage resulting from, or relating to, them.
Works of intellectual property have all been created or produced by the mind. These works are protected by law and the rightholder has the sole right to dispose of them. If you wish to use a piece of work covered by intellectual property, you must first request permission to use it from the copyright holder. An example of an intellectual property work is a copyrighted work, e.g. a book, a painting or an image.
